Terms of Service
Effective date: April 20, 2026 · These Terms govern use of the BYOB mobile application and the services at https://buildyourownbrainrot.com.
1. Agreement
By downloading, accessing, or using BYOB (build your own brainrot memes) or this website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Eligibility & accounts
The game is intended for general audiences and is not directed at children under 13 (or the minimum age in your jurisdiction). If you are under 13, you may not use online features that collect personal information as described in our Privacy Policy unless your parent or guardian has provided any consent required by law (including COPPA where it applies). If you are a parent or guardian, you are responsible for minors’ use of the app on your devices.
BYOB does not require a username-and-password account; progress and certain online features may be tied to a device identifier as described in the Privacy Policy.
This website. Browsing https://buildyourownbrainrot.com (including policy pages and the public leaderboard) is covered by these Terms and the Privacy Policy. We do not operate account sign-up or targeted behavioral ads on these marketing pages. U.S. children’s privacy (COPPA) is explained in the Privacy Policy.
EEA, UK & Switzerland. If you are a consumer there, mandatory statutory rights (including under consumer law and data protection law) apply where they cannot be waived. 3. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use BYOB for lawful entertainment in line with these Terms and the Acceptable Use Policy.
4. Your content
Photos. When you capture an image for Meme Lab, you instruct us to process that image on our servers for safety review and AI generation. You represent that you have the rights needed to submit the image and that it does not violate law or third-party rights.
Generated output. AI-generated images are produced for your personal, non-commercial entertainment unless you obtain our written consent for other uses. Output may be imperfect; we do not guarantee accuracy, appropriateness for every audience, or non-infringement of third-party rights.
Leaderboard. If you submit a display name, you grant us a license to display that name and associated score on leaderboards in the app and on this website.
5. Fair use
Online features are provided only to support the app as intended. You may not misuse automated tools, attempt to bypass safety or usage limits, or use the service in a way that harms others or our systems. See the Acceptable Use Policy.
6. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE PROHIBITED BY LAW.
8. Indemnity
You will defend and indemnify us against claims arising from your misuse of the service, your content, or your violation of these Terms or applicable law, subject to our right to control defense where required by law.
9. Enforcement
We may suspend or terminate access to the service (including online or leaderboard features) if we reasonably believe you violated these Terms, the Acceptable Use Policy, or applicable law.
10. Changes
We may modify these Terms. We will update the effective date and, where appropriate, provide notice through the app or site. Continued use after changes constitutes acceptance.
11. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules. You agree to the exclusive jurisdiction of state and federal courts located in Delaware for disputes, except where consumer protection law requires otherwise.
If you are a consumer in the EEA/UK, mandatory local protections may apply regardless of this clause.
